Effective 22 March 2022, for the purposes of the OHS Act, labour hire workers are considered employees of the host employer. This will give them the same rights and more protection whilst at host employer’s workplace. Both the labour hire provider and the host employer have shared OHS responsibilities. Prior to these changes, a labour hire worker was typically the employee of the labour hire provider. From 22 March 2022, host employers owe the same duties towards labour hire workers as they do towards their direct employees. An example of these duties includes providing a safe workplace, monitor the health of employees, provide induction and information to employees for health and safety and host employers must consult, cooperate and coordinate with employees.
