The Victorian Government has released an update towards further enhancements of Workplace Safety and Mental Health across the State. On Friday, 21 February 2025, the Allan Labor Government announced new regulations that will strengthen protections for mental health in the workplace, particularly concerning psychosocial hazards.

It’s anticipated the regulations will be made in October and take effect on 1 December this year.

Key observations are:

  • New regulations: The regulations will recognize psychosocial hazards (e.g., bullying, sexual harassment, aggression, exposure to traumatic events) as equally important as physical hazards.
  • Employer obligations: Employers will be required to identify and manage psychosocial hazards within their workplaces.
  • Compliance Code: A Compliance Code will be introduced to guide employers in meeting their duties, with additional guidance on prevention plans for controlling psychosocial hazards.
  • Impact of mental injuries: Mental injuries accounted for 18% of all new WorkCover claims in Victoria in 2023-24, highlighting the growing importance of addressing psychosocial risks.
